Thanks for visiting Nolathane. We have adopted this Privacy Policy to set out, in plain terms, how we collect, use and disclose information across every Nolathane site. Where this policy says “we”, “us” or “our”, it means the Zeder group company responsible for your information, as set out above.

This Privacy Policy applies to information we collect through the Services, and to other information provided to us online or offline by third parties when we associate it with customers or users of the Services. It does not apply to information collected from our employees, contractors or vendors. It does not apply to information you ask us to share with third parties, or to information collected by certain other third parties whose software or services are featured or included in the Services, as described below.

This Privacy Policy describes:

Your consent

Certain features of the Services are subject to specific consent or choice requirements that vary depending on the feature and on applicable law. Where applicable law requires it, we obtain your separate, affirmative opt-in consent for those features through a dedicated consent process at the point you elect to use them, not through your general use of the Services.

Except for Services that require separate affirmative consent, by accessing or using the Services you consent to this Privacy Policy. If you do not agree with it, please do not access or use the Services.

If you are in the United Kingdom or Europe, we do not rely on your general use of the Services as consent. We process your personal information on the lawful bases set out in the privacy notice for UK and EU residents, and we ask for your consent separately where consent is the basis we rely on.

Information gathered through the Services may be transferred, used and stored in Australia, the United States, the United Kingdom, or other countries where we or our service providers are located. If you use the Services, you agree to the transfer, use and storage of your Personal Information (as defined below) in those countries. The data protection and other laws of those countries might not be as comprehensive as those in your country. Where we transfer personal information out of the United Kingdom or the European Economic Area, we do so under the safeguards described in the UK and EU notice below.

If you purchase from our United States site, you agree that all transactions relating to those Services are deemed to occur in the United States, where the servers for that site are located.

What personal information we collect

When you register for or use our Services, we collect Personal Information. By “Personal Information” we mean information that can identify, or can reasonably be linked to, an individual, such as:

  • names
  • email addresses
  • postal addresses, including billing and shipping addresses
  • telephone numbers
  • company name, where you buy from us as a business or trade customer
  • account login details and marketing preferences
  • order and transaction details, including the products you purchase and payment information processed by our payment providers
  • information contained in any image, photograph or profile you submit to us

You may choose not to provide Personal Information, subject to the controls offered by your device’s operating system, but this may prevent you from receiving certain features of the Services.

We do not seek to collect special category data, sensitive personal information or sensitive information, as those terms are used in the laws of the places we operate, and we ask that you do not send it to us.

Social media connections

Our Services may link with social media platforms, including LinkedIn, Meta and TikTok. When you link a social media account to our Services, we may collect information about that account and share information with it as described in the connection process. The information collected may include your name, email address, demographic information from your profile, friend lists, postings or other content, and your profile picture. We are not responsible for the data collection or use practices of any linked social media platform. Read each platform’s privacy policy before linking an account.

Chat and session replay tools

We use chatbot technology from our Service Provider (as defined below), Chatra, to collect user chat data, which generates a transcript of your communication with us once the conversation has concluded. Data collected may also include technical and usage data. We use this data only to provide information you have requested, to process transactions you have requested, to help us understand how users interact with our Services, and to design a better user experience for you.

We may also use technology from our Service Provider, Microsoft Clarity, to collect user experience data, which reproduces your interactions with the Services, including mouse movements, page scrolling, screen taps and other actions you take while using the Services. We may replace these third party service providers without giving notice to you. Reproduced data may include technical and usage data, as well as visual representations of actions you take while using the Services. We use this data only to help us understand how users interact with our Services and to design a better user experience for you.

Non-personal information

We also collect non-Personal Information relating to the Services, meaning information that does not personally identify an individual (“Non-Personal Information”). It includes how you interact with the Services, information generally collected or logged by internet websites and services when accessed or used, and information about your web browser or the device you use.

Examples of the non-Personal Information we collect are:

  • the pages of our websites you viewed during a visit
  • what information, content or advertisements you view or interact with using the Services
  • language preferences
  • the city and state or region in which you are located, but not your precise geographic location
  • unique identifiers that are not connected, and cannot reasonably be connected, to your identity

We will not use non-Personal Information to try to identify you. If we associate non-Personal Information with information that personally identifies you, we will treat it as Personal Information. As described below, we sometimes use cookies and other automatic information gathering technologies to gather both Personal Information and non-Personal Information.

Information collected by the Services may be collected by us or by one of the third parties we use in providing the Services, as described below.

How we use your information

We may use the information we collect to:

  • assist us in providing, maintaining and protecting the Services
  • set up, maintain and protect accounts used to access the Services
  • improve our online operations
  • process transactions, including payment, fulfillment and delivery of your order
  • provide customer service, including warranty, returns and fitment support

How we share your information

We may disclose your Personal Information to third parties as described in this section.

We may disclose Personal Information to provide the Services, or when you authorize or instruct us to do so, for example when you use the Services to submit content or profile information. We may also disclose Personal Information and non-Personal Information within the Zeder group, and to Service Providers. By “Service Providers” we mean companies, agents, contractors, service providers or others engaged to perform functions on our behalf, such as processing payments, providing data storage, hosting our websites, shipping your order, marketing our products and services, and conducting audits. When we use a Service Provider, we require that it use and disclose the Personal Information it receives from us only to provide its services to us, or as required by applicable law.

We may also disclose Personal Information and non-Personal Information to Online Tool Providers. By “Online Tool Provider” we mean a licensor of software that we include in, or use with, the Services, including an API or SDK, that provides a specialized function or service to us and that requires the transmission of Personal Information or non-Personal Information to that provider. Online Tool Providers may have the right to use Personal Information and non-Personal Information about you for their own business purposes. Use and disclosure of information by an Online Tool Provider is described in its own privacy policy.

We may partner with advertisers to provide you with special offers, or to advertise products or services to you. If you redeem or respond to an offer, we may provide your Personal Information to the advertiser, including your name, email address and gender. If you answer questions or fill out surveys from an advertiser, we may share information with that advertiser. The advertiser’s privacy policy will govern its use of your information, which may include marketing other products or services to you. Read each advertiser’s privacy policy before providing information to that advertiser.

We may also disclose your Personal Information to third parties when we believe, in good faith and in our sole discretion, that disclosure is reasonably necessary to:

  • enforce or apply the terms and conditions of the Services, including investigating potential violations
  • comply with legal or regulatory requirements or an enforceable governmental request
  • protect the rights, property or safety of us, our users or other third parties
  • submit insurance claims, cooperate with insurance investigations and fulfill insurance subrogation activities

We reserve the right to transfer information, including your Personal Information, to a third party in the event of a sale, merger or transfer of all or substantially all of the assets of our company relating to the Services, or in the unlikely event of a bankruptcy, liquidation or receivership of our business. We will use commercially reasonable efforts to notify you of such a transfer, for example by email or by posting notice on our websites.

We may also disclose non-Personal Information, aggregated with information about our other users, to our clients, business partners, merchants, advertisers, investors, potential buyers and other third parties where we deem such disclosure, in our sole discretion, to have sound business reasons or justifications.

Cookies and other tracking technologies

Every time you use the Services, for example when you access a page on one of our sites, we collect Personal Information and non-Personal Information regarding that use. To improve our Services we collect how, when and which parts of the Services or their features you use, which social media platforms you connect to the Services, and when, how and what you post to those platforms through the Services. We may use your device’s unique identifier (UDID) or other unique identifiers to assist us in collecting and analyzing this data.

To assist us in collecting and storing this non-Personal Information, we may employ a variety of technologies, including cookies, local browser storage, and web beacons, pixels or tags. A cookie is a small amount of data that a website operator, or a third party whose content is embedded in that website, may store in your web browser and read when you visit the site. A web beacon, pixel or tag is a small, usually transparent image placed on a web page that allows the operator of that image, which may be us or a third party, to read or write a cookie.

Your operating system and web browser may allow you to erase information stored in cookies and local browser storage. If you do, you may be forced to log in to the Services again, and you may lose some preferences or settings. You may also be able to set your browser to refuse all website storage, or to indicate when it is permitted, but some features of our Services may not function properly without it. We may use cookies to keep you logged in, save your preferences for the Services, and collect information about how you use the Services.

If you are in the United Kingdom or Europe, we set non-essential cookies and similar technologies only after you have given consent through the cookie banner shown when you first visit one of our sites. Strictly necessary cookies, which make the site work and let you complete an order, are set without consent because the site cannot function without them. You can change or withdraw your cookie consent at any time through the cookie settings link on our sites, and withdrawing consent does not affect anything we did before you withdrew it.

Third party tracking technologies we use

Online Tool Providers, cookies, web beacons, pixels, tags and similar third party technologies are referred to together in this Privacy Policy as “Tracking Technologies”. We use Tracking Technologies to help identify and track visitors, analyze how the Services are used, and understand user preferences. These Tracking Technologies may collect information automatically, including Personal Information and other information, which is subject to the privacy policies of the applicable providers. We do not control these providers’ data practices, and the use and disclosure of information collected by them is governed by their respective privacy policies. Your choices, transparency and do not track signals

Accessing, correcting and deleting your information

You may request access to your Personal Information by emailing us at [email protected]. We will try to locate and provide your Personal Information and give you the opportunity to correct it if it is inaccurate, or to delete it at your request. In either case we may need to retain it for legal reasons or for legitimate business purposes. You may also remove any content you post to the Services using the deletion or removal options within the Services. Neither we nor you can control information you have already shared with other users, or made available to third parties, through the Services.

If you need further help removing content you posted through the Services, email us at [email protected]. Removal of your posted content may not ensure complete or comprehensive removal from our computer systems.

We ask individual users to identify themselves, and the information they want accessed, corrected or removed, before we process a request. We may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, would be extremely impractical (for instance, requests concerning information residing on backups), or relate to information that is not associated with your Personal Information. Where we provide access and correction, we do so free of charge, except where doing so would require disproportionate effort. We may require you to verify your identity to our satisfaction before providing access to Personal Information.

If you ask us to delete your Personal Information, you may not be able to continue using the Services. Even where you request deletion, we may need to retain certain information for a limited period to satisfy our legal, audit or dispute resolution requirements.

Interest based advertising

We may use third party service providers that collect information for interest based advertising, meaning advertisements tailored to your likely interests based on categories in which you have shown an interest. Global Privacy Control and do not track

We honor the Global Privacy Control, a browser extension that automatically communicates a consumer’s opt-out preferences. We also support the development and implementation of other standardized do not track signals, universal opt-out mechanisms and similar browser features that give customers control over the collection and use of information about their web browsing activities. Once other standardized do not track features are widely recognized, we intend to adhere to them.

Marketing emails and text messages

You can opt out of receiving marketing emails from us by clicking the unsubscribe link in any of those emails. It may take up to ten (10) business days for your opt-out request to be processed. Even if you opt out of marketing emails, we may continue to send you certain account related emails, such as notices about your account and confirmations of transactions you have requested.

If you have consented to receive marketing text messages from us, you can opt out at any time by replying STOP to any message you receive from us, or by emailing [email protected]. Message and data rates may apply.

Children

The Services are not intended for users under 18 years of age. We do not knowingly collect Personal Information from users under 18 years of age. We do not authorize users under 18 years of age to use the Services. If you believe a child has provided us with Personal Information, contact us at [email protected] and we will delete it.

How we protect your information

We use reasonable information security measures to safeguard your Personal Information against unauthorized access, modification or destruction. For example, we use Transport Layer Security (TLS), or similar encryption technology, when sensitive data is transmitted over the internet, and we use firewalls to help prevent external access into our network. No data transmission over the internet and no method of data storage can be guaranteed to be 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its security.

We restrict access to the Personal Information in our possession to our employees, Service Providers and Online Tool Providers who need to know that information in order to operate, develop, improve or support our Services.

Third party websites

The Services may link or integrate with third party sites, services or apps. We are not responsible for the privacy or security policies or practices, or the content, of those third parties. We encourage you to review their privacy and security policies and terms of service so you understand how they collect, use, share and protect your information.

Changes to this policy

We may modify or update this Privacy Policy periodically, with or without prior notice, by posting the updated policy on this page. You can always check the “Last updated” date at the top of this page to see when it was last changed. If we make material changes, we will notify you by reasonable means, which may be by email or by posting notice of the changes on our websites before they take effect. We encourage you to check this Privacy Policy from time to time. If you do not agree to changes to this Privacy Policy, you must stop using the Services after the effective date of those changes, which is the “Last updated” date shown above.

Privacy notice for USA and California residents

This Privacy Notice for California Residents (the “Notice”) supplements the information in our Privacy Policy and applies only if you reside in the State of California, in which case you are a “California Consumer”. Zeder USA, LLC is the business responsible for the Personal Information covered by this Notice.

Definitions used in this notice

“Sell”, “Selling”, “Sale” or “Sold” means selling, renting, releasing, disclosing, disseminating, making available, transferring or otherwise communicating orally, in writing, or by electronic or other means, Personal Information to another business or a third party for monetary or other valuable consideration.

“Share”, “Shared” or “Sharing” means sharing, renting, releasing, disclosing, disseminating, making available, transferring or otherwise communicating orally, in writing, or by electronic or other means, Personal Information to a third party for Cross-context Behavioral Advertising, whether or not for monetary or other valuable consideration.

“Cross-context Behavioral Advertising” means the targeting of advertising to a consumer based on that consumer’s Personal Information obtained from activity across businesses or distinctly branded websites, applications or services, other than the business or distinctly branded website, application or service with which the consumer intentionally interacts. In other words, if we send you an ad based solely on your interaction with us or our Services, that is not Cross-context Behavioral Advertising.

“Sensitive Personal Information” means Personal Information that is not publicly available and reveals one or more of the following:

  • a consumer’s Social Security, driver’s license, state identification card or passport number
  • a consumer’s account log-in, financial account, debit card or credit card number in combination with any required security or access code, password or credentials allowing access to an account
  • a consumer’s precise geolocation
  • a consumer’s racial or ethnic origin, religious or philosophical beliefs, or union membership
  • the contents of a consumer’s mail, email and text messages, unless we are the intended recipient of the communication
  • a consumer’s genetic or biometric data
  • a consumer’s neural data
  • Personal Information collected and analyzed concerning a consumer’s health, sex life or sexual orientation

“Verifiable Request” means that the identifying information a consumer provides with a request matches the Personal Information we already maintain about that consumer. Identifying information you can submit so we can verify your Verifiable Request may include your first and last name, the email address associated with your account, and a secure confirmation code we provide to you by email.

2. Use of personal information

We may use or disclose the Personal Information we collect for one or more of the following “Business Purposes”:

  • to fulfill or meet the reason you provided the information
  • to provide our websites or online services
  • to respond to law enforcement requests and as required by applicable law, court order or governmental regulations
  • to respond to your requests under the CCPA, as amended
  • for any other purpose described to you when we collect your Personal Information
  • for any other acceptable purposes set out in the CCPA

Unless we notify you otherwise, we will not collect additional categories of Personal Information, nor use the Personal Information we collect for any other materially different, unrelated or incompatible purpose.

3. Retention of personal information

We retain each category of your Personal Information for no longer than is reasonably necessary for one or more Business Purposes, subject to your right to request that we delete it. Given the nature of the Services, it is not possible to predict the length of time we intend to retain your Personal Information. Instead, we use the following criteria to determine whether it remains reasonably necessary to retain it for one or more disclosed Business Purposes:

  • whether there is a retention period required by statute or regulation
  • the pendency of any actual or threatened litigation for which we are required to preserve the information
  • generally accepted best practices in our industry
  • the pendency of applicable statutes of limitations for potential legal claims

When we determine, based on those criteria, that it is no longer reasonably necessary to retain your Personal Information for a disclosed Business Purpose, we will delete it.

4. Disclosure of personal information

We may disclose Personal Information to our “service providers”, to our “contractors” and to “third parties”, each as defined by the CCPA, for a Business Purpose. When we disclose Personal Information for a Business Purpose, we enter into an agreement with the receiving party describing the purpose of the disclosure and requiring that party to keep the Personal Information confidential. Our service providers are obligated not to use the Personal Information for any purpose other than performing the services set out in their agreement with us. Our contractors are obligated not to use the Personal Information for any purpose unrelated to the business purpose for which we engaged them.

We may disclose your Personal Information to the following categories of entities: service providers (as described in the Privacy Policy) and contractors.

In the past twelve (12) months, we have not Sold or Shared any Personal Information about our California Consumers.

5. Your rights and choices

If you are a California Consumer, you may request information about our collection, use, disclosure and Sale of your Personal Information over the past twelve (12) months, whether or not it was collected electronically. If you submit a Verifiable Request, we will provide you with:

  • the categories of Personal Information we have collected about you, the categories of sources from which it was collected, our Business Purpose for collecting, Selling or Sharing it, the categories of third parties to whom we disclose it, and the specific pieces of Personal Information we collected about you
  • if we Sold, Shared or disclosed your Personal Information for a Business Purpose: the categories of Personal Information we Sold or Shared and the categories of recipients, and the categories of Personal Information we disclosed for a Business Purpose and the categories of recipients

You also have the right to request a copy of your Personal Information, and to request that we transmit it to another entity. To the extent technically feasible, we will comply and provide or transmit your Personal Information in a structured, commonly used, machine readable format.

 

You have the right to request that we delete any of your Personal Information that we collect or maintain, by submitting a Verifiable Request. We may deny your deletion request if retaining your Personal Information is necessary for us, our service providers or our contractors to:

  • complete the transaction for which we collected your Personal Information, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide goods or services you requested, take actions reasonably anticipated by you within the context of our ongoing business relationship with you, or otherwise perform our contract with you
  • help to ensure security and integrity, to the extent the use of your Personal Information is reasonably necessary and proportionate for those purposes
  • debug products to identify and repair errors that impair existing intended functionality
  • exercise free speech, ensure the right of another consumer to exercise that consumer’s right of free speech, or exercise another right provided for by law
  • comply with the California Electronic Communications Privacy Act (Cal. Penal Code section 1546 et seq.)
  • engage in public or peer reviewed scientific, historical or statistical research that conforms or adheres to all other applicable ethics and privacy laws, where deletion may render impossible or seriously impair the ability to complete that research, if you previously provided informed consent
  • enable solely internal uses reasonably aligned with consumer expectations based on your relationship with us and compatible with the context in which you provided the information
  • comply with a legal obligation

You further have the right to request that we correct any of your Personal Information that is inaccurate, by submitting a Verifiable Request. We will correct inaccurate Personal Information to the extent possible using commercially reasonable efforts. We may deny your correction request if the Personal Information is accurate. We may also delete your Personal Information instead of correcting it, to the extent deletion would not negatively impact you.

If you choose to exercise a privacy right under the CCPA, you have the right not to receive discriminatory treatment.

After we receive your Verifiable Request, we will provide the requested information to you in writing and free of charge, unless your request is excessive, repetitive or manifestly unfounded, for the 12 month period preceding your request. If you specifically request disclosure beyond that period we will process your request for the time period you specify, provided that the earliest date your request may apply to is January 1, 2022, and that processing it does not require disproportionate effort. How long we keep your data

Dealing with us anonymously

Sending your information overseas

The Zeder group operates in Australia, the United States, the United Kingdom and Vietnam, and some of our service providers are located overseas, including in the United States and the European Union. Your personal information may be disclosed to those countries so we can operate our sites, process your order and support you. We do not adopt a government related identifier, such as a tax file number or driver’s license number, as our own identifier for you.

What personal information does Nolathane collect?

We collect your name, email address, billing and shipping addresses, phone number, company name where you buy as a trade customer, account and order details, and payment information handled by our payment providers. We also collect device and browsing data such as IP address, browser type, pages viewed and referring source, through cookies and similar technologies.

Does Nolathane sell my personal information?

No. We do not sell your Personal Information, and in the past twelve months we have not Sold or Shared Personal Information about California Consumers. We will not Sell or Share your Personal Information without first obtaining your consent.

How do I request a copy of my data, or ask for it to be corrected or deleted?

Email [email protected] with the request and enough detail for us to identify you. We may ask you to verify your identity first. Response times depend on where you are: forty-five (45) days in California with one possible extension, one month in the UK and Europe with a possible two month extension, and 30 days in Australia.

How do I stop marketing emails and text messages?

Click the unsubscribe link at the bottom of any marketing email, which can take up to ten (10) business days to process. For text messages, reply STOP to any message you receive from us. Account and transaction emails, such as order confirmations and shipping notices, will continue.
